Who can get new style ESA?

New style employment and support allowance

You can get new style ESA if your ability to work is limited by ill health or disability.

You must:

  • be aged 16 or over
  • be under pension age (ESA stops when you reach that age)
  • not be entitled to income support, jobseeker’s allowance or statutory sick pay
  • not be in work; however some types of work are permitted (see our information on permitted work
  • pass the national insurance contributions test
  • have a limited capability for work. This is tested under the work capability assessment
  • be present in Great Britain (or Northern Ireland) if you live there

If you are a student (full time or part time), you can claim new style ESA if satisfy all of these rules.
