Enforcement and dispute resolution - a future partnership paper

This Department for Exiting the European Union paper discusses options for enforcement and dispute resolution mechanisms for UK-EU agreements.

The European Union (Withdrawal) Bill provides that direct jurisdiction of the Court of Justice of the European Union (CJEU) in the UK will end at the point of our withdrawal from the EU.

This paper examines situations where it may be necessary to apply new European law post-Brexit but makes it clear that, where appropriate, this will be enshrined in British law and decided by British courts. 

The paper also discusses agreements where Britain may have to take account of EU law and makes suggestions for possible ways of dispute resolution.
